This is just practical information about car insurance and is not a legal advice. It is still best to consult with an attorney who is experienced with personal injury if you need an expert advice regarding car accident insurance.
During a car accident where you got injured, you must know how to deal with the insurance & liability issues. The best thing that could happen is that both parties would handle the matter well regarding the bills and medical care through their insurance companies. The insurance company would then pay for the bills and there is no problem. But what if the other person involved in automobile accident says that (s)he isn’t at fault and that it’s your fault. But you believe otherwise. Or what if you don’t own the car you are driving or the other person is not driving his or her own car? Or what if you are driving your company’s car or you ended up missing some work days? What if the other driver actually doesn’t have car insurance or your car insurance coverage refused to pay for damages or the medical coverage is not enough?
These are just some cases when you’d need the help of a personal injury lawyer. If you hire one, all communications regarding the matter would go through him/her first. The attorney will make consultations with you and calculate the damages and try to settle out of court. When you need to be in a hospital for medical treatment, the attorney would have to wait until you get discharged so he/she could present all medical bills to the car insurance company to make the claim. If everything works well, the car insurance will settle and pay you the exact amount or at least close to that amount. But if there are several disagreements, it can get quite complicated and the insurance company might decide to settle the case in court. This would mean more expenses for you and it can take longer too.
Usually when the car damage is worth over $5,000, PI attorneys are mostly going to accept the case. If damages and medical bills are worth less than $5,000 then it could be settled outside of court and there’s no need for an attorney. You also have to take note that sometimes a car insurance company of the party who is at fault may offer you settlement before you get an attorney. This can be quite attractive that you may want to accept but be cautious too because if you accept their offer, anything that will happen to you later as a result of the accident or if your car would eventually break down as a result then you can’t run after them anymore. It’s best to think about it and seek for an attorney’s suggestion first.
